Welcome to Our Terms and Conditions
Terms and conditions note: This policy is provided for general information and should be reviewed by a qualified attorney before launch.
These terms and conditions are the rules that apply when you use customcarts.com or buy a golf cart, part, or accessory from Custom Carts (“Custom Carts,” “we,” “us,” or “our”). We are a golf cart dealer in Northeast Ohio selling new and used gas, electric, and lithium golf carts, including street-legal models. We have written these terms and conditions in plain English so you know what to expect before you buy.
By browsing the site, creating an account, placing a deposit, or completing a purchase, you agree to these terms and conditions. If you do not agree, please do not use the site or place an order. If anything is unclear, call us at (330) 752-8570 before you buy. We would much rather answer a question up front than have a surprise later.
Who you are dealing with
Custom Carts is based in Northeast Ohio. You can reach us at (330) 752-8570 or info@customcarts.com. Automated order emails are sent from no-reply@customcarts.com, which is not monitored. These terms and conditions work together with our Privacy Policy and our return policy, and together they form the full agreement for using our site.
Using Our Website
You may use our website to browse inventory, compare carts, read our guides, and contact us. Under these terms and conditions, you agree to use the site only for lawful purposes and in a way that does not harm the site or other visitors.
Things you agree not to do
- Submit false information, place fake orders, or impersonate another person.
- Try to hack, overload, scrape, or interfere with the site or its security.
- Copy our photos, descriptions, or content for commercial use without permission.
- Use the site to send spam or harmful code.
Your account
If you create an account in our store, you are responsible for keeping your password safe and for activity under your account. Tell us right away if you think someone else has used it. We may suspend or close accounts that break these terms and conditions.
Age requirement
You must be at least 18 years old and able to enter a binding contract to place an order. Golf carts are motor vehicles, and they should be operated only by people allowed to do so under local rules and the manufacturer’s guidelines.
Product Listings, Pricing and Availability
We work hard to keep our listings accurate, but golf carts are often one-of-a-kind, especially used carts. Here is how these terms and conditions treat listings:
- Photos: used cart photos show the actual cart when possible. New cart photos may show a representative model, and colors can look different on screens.
- Specifications: specs come from the manufacturer or from our inspection. If something matters to you, ask us for the full spec sheet before you buy.
- Pricing: prices can change without notice until your order is confirmed. Prices do not include sales tax, title fees, registration fees, or delivery unless stated.
- Availability: a cart listed online may already be on hold or sold. Your order is not final until we confirm it with you.
- Errors: if a listing contains an obvious pricing or description error, we may correct it and cancel any order based on the error, with a full refund of your deposit.
Browse current inventory in our shop, or explore new golf carts and used golf carts.
Orders, Phone Confirmation and Deposits
Golf carts are large vehicles, and every sale involves details that are best handled in conversation, such as delivery access, options, trade-ins, and paperwork. For that reason, these terms and conditions set out a process that is a little different from a typical online store.
How an order works
- Request or deposit: you contact us, submit an inquiry, or place a deposit online to hold a cart.
- Phone confirmation: we call you to confirm the cart, price, options, taxes, fees, delivery or pickup, and payment method.
- Acceptance: your order is accepted only when we confirm it with you by phone or in writing. An automated order email is a receipt, not an acceptance.
- Final payment: the balance is due before or at delivery or pickup, as agreed during confirmation.
- Delivery or pickup: we schedule a date that works for you once payment arrangements are complete.
Deposits
A deposit holds a specific cart for you while we finish the details. The amount will be shown at checkout or agreed by phone. Your deposit is applied to the purchase price. The rules on refundable and non-refundable deposits, cancellations, and timing are explained in our return policy, which forms part of these terms and conditions.
Our right to decline an order
We may decline or cancel an order before acceptance, for example if the cart is no longer available, a listing contained an error, we suspect fraud, or we cannot deliver to your area. If we cancel, we will refund any deposit you paid in full.
Payments and Financing
Payments made on our website, including online deposits, are processed by third-party payment processors. By paying, you also agree to the processor’s terms. We do not store full card numbers. Other accepted payment methods for the balance will be confirmed during your order call.
Financing
Financing is available through third-party lenders with approved credit. The lender, not Custom Carts, makes the credit decision and sets the rate, term, and conditions of your loan. Any promotional financing offer is subject to the lender’s approval and may change or end at any time, so please ask about current offers. Your loan agreement with the lender is separate from these terms and conditions. See our financing page for more.
Trade-ins
We welcome trade-ins. Any trade-in value we quote is an estimate until we inspect the cart in person. You must own the trade-in cart free and clear, or disclose any lien, and you must provide any title or proof of ownership. Learn more on our trade-in page.
Taxes and fees
You are responsible for applicable Ohio sales tax and any title, registration, or documentation fees. We will show these to you before your order is accepted. Under these terms and conditions, no hidden fees are added after you confirm.
Delivery, Pickup and Transfer of Ownership
After your order is accepted and payment arrangements are made, we schedule delivery or pickup. Local delivery is available in our area, and wider delivery is quoted on request. See our shipping and delivery page for details.
- Access: you are responsible for giving us an accurate address and a safe, reachable place to unload the cart.
- Timing: delivery dates are estimates. Weather, road conditions, and manufacturer delays can affect timing, and we will keep you informed.
- Inspection: please inspect the cart when it arrives and note any visible damage on the delivery paperwork before signing.
- Pickup: if you pick up, bring a suitable trailer and straps. You are responsible for securing the cart once it is loaded.
Title and risk of loss pass to you when the cart is delivered to you or loaded onto your trailer, and full payment has been received. Under these terms and conditions, carts left unclaimed after a scheduled pickup date may be subject to reasonable storage fees after we notify you.
Street-Legal Carts, Titles and Safe Use
Some carts we sell are low-speed vehicles (LSVs) or can be equipped for street use. Whether a cart can be driven on public roads depends on federal standards, Ohio law, and your local rules. Federal safety standards for low-speed vehicles are set by the National Highway Traffic Safety Administration, and titling and registration in Ohio are handled by the Ohio Bureau of Motor Vehicles.
We will help with paperwork where we can, but these terms and conditions make you responsible for confirming that your intended use is legal where you live, and for insuring, titling, and registering the cart when required. Read our guide to street-legal golf carts in Ohio for background.
Safe operation
- Follow the owner’s manual and all safety labels.
- Do not exceed the seating capacity or load limits.
- Do not allow unlicensed or underage drivers where the law forbids it.
- Do not modify speed controllers, brakes, or lift kits in ways the manufacturer does not approve.
Custom Carts is not responsible for injury, damage, fines, or losses caused by unsafe operation, illegal use, or modifications made after the sale.
Warranties and Disclaimers in These Terms and Conditions
New carts
Many new carts come with a manufacturer’s warranty. For example, some Denago models carry a 2-year cart warranty and an 8-year battery warranty. Warranty coverage is provided by the manufacturer, not by Custom Carts, and is governed by the manufacturer’s written warranty terms. We will help you register your cart and file warranty claims. Visit our warranty page or the manufacturer’s site, such as Denago EV, for details.
Used carts
Unless we give you a written warranty for a specific cart, used carts are sold “as is,” with no warranty from Custom Carts. Any remaining manufacturer warranty may transfer depending on the manufacturer’s rules. We encourage you to inspect any used cart, ask questions, and review our used golf cart checklist before you buy.
General disclaimer
Except for any written warranty we or a manufacturer provide, and to the fullest extent permitted by Ohio law, Custom Carts disclaims all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some laws do not allow certain disclaimers, so parts of this section may not apply to you. Nothing in these terms and conditions limits rights you have that cannot be waived by law.
Cancellations, Returns and Refunds
Because each cart is prepared for a specific buyer, cancellations and returns work differently than they do for small online purchases. Our full rules are set out in our return policy, and the short version under these terms and conditions is below.
- Before acceptance: if you cancel before we confirm your order, your deposit is refunded.
- After acceptance: deposits may be partly or fully non-refundable once a cart has been held, ordered, customized, or prepared for you, as explained when you confirm your order.
- At delivery: inspect the cart carefully and note any visible damage before signing. Report hidden problems as soon as you find them.
- Refunds: approved refunds go back to the original payment method, and your bank or card issuer controls how quickly they appear.
If there is ever a conflict between these terms and conditions and the return policy on a return or refund question, the return policy controls.
Parts, Accessories and Service
We also sell parts and accessories such as lift kits, seats, lights, covers, and batteries, and we can help arrange setup work on carts we sell. These terms and conditions apply to those purchases too.
Compatibility
Parts are listed for the models they are designed to fit. Before you order, please confirm the make, model, and year of your cart, or call us and we will check compatibility with you. We are not responsible for parts that do not fit a cart that was described incorrectly when the order was placed.
Installation
If you install a part yourself, follow the manufacturer’s instructions. Some modifications, such as lift kits or speed changes, can affect handling, safety, and warranty coverage. Ask us before you modify a new cart so you do not lose manufacturer warranty protection.
Work we perform
When we install accessories before delivery, we will describe the work and price during your order call. Any labor warranty we offer will be stated in writing on your paperwork, and it will be governed by these terms and conditions.
Limitation of Liability
We stand behind the carts we sell, and we want every customer to be happy. At the same time, these terms and conditions set sensible limits on our liability, as most businesses do.
To the fullest extent allowed by law, Custom Carts will not be liable for indirect, incidental, special, or consequential damages, such as lost time, lost enjoyment, or rental costs, arising from your use of the site or a cart. Our total liability for any claim related to a purchase will not exceed the amount you paid us for that purchase.
These limits do not apply to liability that cannot be limited by law, such as liability for our gross negligence or intentional misconduct. You agree to indemnify Custom Carts against claims arising from your misuse of a cart or your breach of these terms and conditions.

Terms and Conditions FAQs
Is my order final when I place a deposit online?
No. Under our terms and conditions, an order is accepted only after we confirm it with you by phone or in writing. The automated email you receive is a receipt for your deposit.
Are prices on the website final?
Prices can change until your order is confirmed. Sales tax, title, registration, and delivery are usually added separately, and we review every cost with you before you commit.
Who provides financing?
Financing is offered through third-party lenders with approved credit. The lender makes the credit decision and sets the loan terms. Ask about current offers when you call.
Do used carts come with a warranty?
Used carts are sold as is unless we give you a written warranty for that specific cart. Any remaining manufacturer coverage may transfer, depending on the manufacturer.
Can I drive my golf cart on the street?
Only if the cart and your use meet federal, Ohio, and local rules. These terms and conditions make you responsible for confirming that, and we are glad to help with paperwork.
